1. basic definitions.

Terms used in the Rules and Regulations shall mean:

  1. Customer - a natural person, a legal person or an organisational unit which is not a legal person but to which special regulations grant legal capacity, who places an Order in the Store.
  2. Civil Code - Act of 23 April 1964 (Journal of Laws 1964 No. 16, item 93 as amended).
  3. Regulations - these Regulations for the provision of electronic services in the amorpleasure.eu online shop
  4. Amor Pleasure online shop - the website available under amorpleasure.eu, through which the Customer may, in particular, place Orders;
  5. Goods - the products presented in the Online Shop.
  6. Contract of sale - a contract for the sale of Goods, as defined by the Civil Code, concluded between Anna Stachewicz and the Customer, concluded using the website of the Store.
  7. Act on consumer rights - Act of 30 May 2014. On consumer rights (Journal of Laws 2014, item 827 as amended).
  8. Order - the Customer's declaration of intent, aiming directly at the conclusion of the Sales Agreement, specifying in particular the type and number of Goods.

2 General provisions

  1. These Terms and Conditions set out the rules for the use of the online shop available at amorpleasure.eu
  2. The online shop, operating under the name amorpleasure.eu, is run by Anna Stachewicz, Ogrody Street 23/25, 85-870 Bydgoszcz, NIP 9532796895, Regon 525532578.
  3. These Rules set out in particular:
    a) the rules for registration and use of an account within the online shop;
    b) the terms and conditions for making electronic reservations for products available in the online shop;
    c) the terms and conditions for placing electronic orders in the online shop;
    d) the principles of concluding Sales Agreements using the services provided by the Internet Shop.

3. Rules for the use of the online shop

  1. Making a purchase of a Product does not require registration in the Shop.
  2. The information provided on the Shop's websites, including information about the presented products, in particular their descriptions, technical and usage parameters and prices, constitute an invitation to conclude a contract, within the meaning of Article 71 of the Civil Code.
  3. The order is placed using a form, available on the shop website.
  4. Each Customer who registers and/or places an order agrees to receive information related to the progress of the transaction, notifications of changes to these Terms and Conditions to the e-mail address provided by the Customer.
  5. In order to ensure the security of the transmission of messages and data in connection with the services provided on the Website, the Online Shop shall take technical and organisational measures appropriate to the degree of security risk of the services provided, in particular measures to prevent the acquisition and modification by unauthorised persons of personal data transmitted on the Internet.

4. Procedure for concluding a sales contract

  1. In order to carry out any of the Customer's activities in the Shop, it is required that the Internet is working correctly, that a web browser is being used, including on mobile devices, and that the Customer has an active account with a selected e-mail address.
  2. In order to conclude a Sales Contract through the Online Shop, one should enter the website amorpleasure.eu, make a selection, taking subsequent technical actions based on the messages displayed to the Customer and information available on the website.
  3. The shop allows you to purchase products and services 24 hours a day, 7 days a week.
  4. The selection of the ordered Goods by the Customer is made by adding them to the shopping basket.
  5. In the course of placing the Order - until the "Place Order" button is pressed - the Customer has the possibility of modifying the data entered and with regard to the selection of the Goods. In order to do so, it is necessary to follow the messages displayed to the Customer and the information available on the website.
  6. In order to finalise the order, the customer is asked to provide all the necessary data needed to complete the order, i.e.
    (a) name of company
    (b) the delivery address
    (c) e-mail
    (d) a contact telephone number
    (e) VAT number, if a VAT invoice is requested.
  7. Once the Customer using the Online Shop has entered all the necessary data, a summary of the Order placed will be displayed. The summary of the Order placed shall contain information concerning:
    (a) the subject matter of the contract,
    (b) the unit price and the total price of the products or services ordered, including delivery costs and additional costs (if any),
    (c) the payment method selected,
    d) the delivery method chosen.
  8. In order to send an Order, it is necessary to accept the content of the Terms and Conditions, provide personal data marked as mandatory and press the "Place Order" button.
  9. The Customer's sending of the Order constitutes a declaration of will to conclude a Sales Contract with COMPANY NAME, in accordance with the content of the Terms and Conditions.
  10. Once the Order has been placed and paid for, the Customer will receive an email entitled "Order Confirmation", containing a final confirmation of all relevant elements of the Order.
  11. The contract shall be deemed to have been concluded upon receipt by the Customer of the aforementioned e-mail.
  12. The contract of sale shall be concluded in the Polish language, with contents in accordance with the Terms and Conditions.

5 Delivery

  1. The prices of the products in the Shop are given in Polish zloty and in Euros and include tax excluding shipping costs. The shipping costs are added to the sum of the ordered products and are paid by the Customer. The final price, binding on the Owner and the Customer, is the price of the product given in the offer at the time the Customer places the order.
  2. Information on the total value of the order (including shipping costs, which are detailed under Delivery and Returns) is made available in the Order Summary on the product sales page and in the order confirmation.
  3. Delivery of the Goods takes place both in the Republic of Poland and in the countries of the European Union to the address indicated by the Customer when placing the Order.
  4. Delivery of the ordered Goods is made by courier service.
  5. For orders with delivery within the territory of the Republic of Poland, the delivery period shall be three working days from the date of payment of the Order by the Customer. For orders to be delivered outside the territory of the Republic of Poland, the delivery period is indicated in the information regarding the form of delivery and the country of destination.
  6. A printout of the Order confirmation and specifications as well as a proof of sale will be provided to the Customer with the delivery. At the Customer's express request, a VAT invoice may be issued.

6 Prices and payment methods

  1. The prices of the Goods are quoted in Polish zloty and include all components, including VAT.
  2. The customer has the option to pay the price:
    a) by bank transfer to the bank account number: 39 1140 2004 0000 3602 8374 4640;
    b) payment via AutoPay, PayPal;
    c) payment by payment card: VISA, MasterCard.

7 Withdrawal

  1. The Customer, being a consumer within the meaning of Article 22 of the Civil Code, has the right, pursuant to the provisions of law, to withdraw from a contract concluded at a distance, without giving any reason, by making a relevant statement in writing or by e-mail to info@amorpleasure.eu, within 14 days and sending it to the address of Anna Stachewicz specified in these Regulations.
  2. In the event of withdrawal from a distance contract, the contract shall be deemed not to have been concluded. What the parties have rendered shall be returned unchanged. The return should take place immediately, no later than within 14 days.   3. Goods returned by the Customer should be packaged in a suitable manner to ensure that the parcel is not damaged in transit.
  4. In the event of cancellation of this contract, the Shop will return to the Customer all payments received from the Customer, including the costs of delivery of the goods (except for the additional costs resulting from the method of delivery chosen by the Customer other than the cheapest method of delivery offered by the Shop), immediately, no later than 14 days from the day on which the goods were returned. The payment shall be refunded using the same means of payment used by the Customer in the original transaction, unless the parties agree otherwise.

8 Returns and complaints policy

  1. In the event that a purchased product is not in conformity with the contract or has physical defects, the customer has the right to lodge a complaint based on:
    a) regulations provided for in the Act of 27 July 2002 on specific terms and conditions of consumer sale and amending the Civil Code (Journal of Laws No. 141, item 1176, as amended), in the event that the product is inconsistent with the agreement,
    (b) the regulations provided for by the Civil Code on warranty for defects.
  2. In order to lodge a complaint, the customer is obliged to inform the shop by e-mail at info@amorpleasure.eu and then proceed in accordance with the information received.
  3. When specifying the demands under the procedure provided for in Article 1(a), the Customer has the right to request that the product be brought into conformity with the contract by means of repair or replacement free of charge, unless repair or replacement is impossible or requires excessive costs. If the shop is unable to meet the specified demands, the Customer has the right to demand an appropriate price reduction or to withdraw from the contract.
  4. The Customer has the right to withdraw from the contract or to demand a price reduction. The Customer may not withdraw from the contract if the Shop replaces the defective item with a defect-free item without delay, at the latest within 14 days, or rectifies the defects immediately. This restriction does not apply if the item has already been replaced or repaired by the Shop, unless the defects are insignificant.
  5. The shop is liable for the non-conformity of a consumer product with the contract (Article 1(a)) only in the cases and under the conditions stipulated by law.
  6. The shop is liable for product defects on the basis of the warranty (Article 1(b)), in the cases and under the conditions stipulated by law.
  7. The shop will consider complaints within 14 days of the date on which the shop receives the complaint application together with the complete, advertised product.
  8. The shop reserves the right to refuse to accept a complaint if any modifications are made to the product by the customer.
  9. The shop reserves the right to refuse complaints in cases of: sole fault of the user, mechanical damage, improper maintenance and use of the product contrary to the instructions.
  10. The shipping costs of the claimed product will be reimbursed to the customer within 14 days of the complaint being accepted.

9. Privacy and data protection policy

  1. In order to finalise the purchase in the Shop, the Customer must provide all the data required by the content of the form and tick a relevant box (checkbox), which constitutes the Customer's consent to have his/her personal data processed by the Owner, as well as a box (checkbox) confirming that he/she has familiarised himself/herself with and accepted these Terms and Conditions.
  2. Any Customer data provided during registration with the Store will be used only for the purpose of implementing, amending or terminating the Agreement or other marketing activities, in particular to inform about new products and services of the Store, provided that the Customer agrees by ticking the appropriate box (checkbox) to the sending of commercial information, by means of electronic communication in the meaning of the new European Parliament and Council Regulation (EU) 2016/679 of 27.04.2016.
  3. All personal data of the Customer will be processed by the Owner in accordance with the content of the aforementioned Act.
  4. The administrator of the customer's personal data is Anna Stachewicz, Ogrody Street 23/25, 85-870 Bydgoszcz, NIP 9532796895, Regon 525532578.
  5. Only personal data provided voluntarily by the Customer is collected. The data is processed for the purpose necessary to perform the provisions of these Terms and Conditions, in particular to conclude a contract of sale of the ordered goods, to deliver the goods ordered by the Customer, to issue a document confirming the sale transaction of the goods, to store the personal data in the IT accounting system to ensure the history of business transactions made through the Shop.
  6. The data you provide when placing an order is also processed by the following entities to the extent specified: name, address, telephone, e-mail indicated as delivery address is forwarded to shipping companies in the form of a shipping label/letter which is also a delivery order. Depending on the type of shipment selected, they are transmitted:
    (a) DPD
    b) INPOST
    (c) FedEX
    (d) DHL
    (e) GLS
    (f) Opek
    (g) Pocztex24
  7. Data is also processed by the entities involved in processing payment for the order:
    a) PayNow
    b) PayPal
    In such cases, the amount of data provided is limited to the required minimum. In addition, the information you provide may be made available to the relevant public authorities if required by applicable law.
  8. The Data Controller is not responsible for any false or incomplete personal data provided by the Customer.
  9. The customer, at any time, has the right via the shop's service office to change, amend or delete his or her personal data.
  10. With additional consent given by the Customer, the collected personal data may also be used for promotional and marketing purposes, including in particular to present the Shop's commercial offer to the Customer and other marketing information related to the Shop.
  11. Every user has the possibility to subscribe to the newsletter - commercial information. Subscribing to the list takes place by ticking the appropriate box in the form at the registration stage (only the e-mail address is needed for this purpose). You can unsubscribe from the newsletter at any time via the link provided in the newsletter or by informing the Shop by email to info@amorpleasure.eu. Upon cancellation, your e-mail address data will be immediately deleted from the subscription database.
  12. Among other things, the Shop uses so-called "cookies", which contribute to greater usability, functionality and ease of use of our Shop. These instruments also make it easier for customers to navigate the Shop website more quickly. In addition, cookies allow us to measure the frequency of page views and the most viewed products. Cookies are small text files which are stored on your computer system. Please be advised that some of these files are transferred from the Shop's server to the Customer's computer system. It is possible to block cookies at any time, provided that the browser you are using has an appropriate function. Please note that if cookies are blocked, the ability to use some of the Shop's functions will be significantly reduced or disabled.

10. online shop reviews

  1. The customer of the Online Shop has the possibility of voluntarily and free of charge issuing an opinion concerning purchases made in the Online Shop. The subject of the opinion may also be an assessment, a photo or a review of the product purchased in the Online Shop.
  2. After making purchases in the Online Shop, the Seller transfers data necessary to create an email invitation to the company handling the survey process.Sending surveys and the process of collecting opinions in forms is fully handled by the company TrustMate SA with its registered office at Bartoszowicka 3, 51-641 Wrocław. TrustMate SA sends an email to the customer with a request for an opinion and a link to an online form that enables the customer to give an opinion - the online form enables the customer to answer the seller's questions about their purchase, rate it, add their own description of the opinion and a photo of the purchased product. If a rating has not been submitted after the initial invitation to submit a rating, TrustMate may resend the invitation.
  3. A review can only be issued by a Customer who has made a purchase from the Seller's Online Shop.
  4. The reviews submitted by the Customer are published by the Seller in the Online Shop and on the TrustMate.io business card.
  5. The submission of an opinion may not be used by the Customer for illegal activities, in particular for activities that constitute an act of unfair competition against the Seller or activities that infringe personal rights, intellectual property rights or other rights of the Seller or third parties.
  6. A review may only be issued for products actually purchased from the Seller's Online Shop. It is prohibited to enter into fictitious/apparent sales contracts in order to issue an opinion. Nor may the author of an opinion be himself. Seller nor his or her employees regardless of employment basis.
  7. A submitted review can be removed by its author at any time.

11 Final provisions

  1. All contents of the Shop are protected by law and their use will constitute an infringement of the law.
  2. In matters not covered by these Terms and Conditions, the provisions of Polish law, in particular the Civil Code and the provisions of the Act on Special Terms of Consumer Sales and Amendments to the Civil Code of 18 July 2002 (Journal of Laws 2001 No. 144 item 1204) the provisions of the Consumer Rights Act of 30 May 2014 shall apply.
